Welcome to Call Snag (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the Call Snag mobile application and related services (the “Service”). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If under 18, you may only use the Service under the supervision and consent of a parent or legal guardian.
2. User Accounts
To access certain features, you may need to create an account. You agree to:
- Provide accurate, current information;
- Maintain the confidentiality of your credentials;
- Accept responsibility for all activities that occur under your account.
3. Call Handling and Carrier Responsibility
Call Snag may require the use of conditional call forwarding or similar features through your mobile carrier. You are solely responsible for enabling these services and for any charges incurred from your carrier.
By using Call Snag, you expressly authorize the redirection, interception, storage, and analysis of your incoming calls and voicemails by our system.
4. AI Processing and Voice Content
Call Snag uses machine learning and AI to transcribe and analyze voicemail and call data. You grant us permission to:
- Access, store, and process audio recordings, metadata, and transcriptions;
- Use anonymized data to improve the performance and accuracy of the Service;
- Deliver summaries or automated responses based on call content.
All data processing is subject to our Privacy Policy, which governs how we handle your personal information.
5. Subscriptions and Billing
Certain features are available only through paid subscriptions. By subscribing, you authorize Call Snag to charge your selected payment method through the Apple App Store.
All payments are non-refundable except where required by law. You may cancel subscriptions through your App Store account settings.
6. Acceptable Use
You agree not to:
- Use the Service for illegal or fraudulent activities;
- Interfere with or disrupt the Service or its infrastructure;
- Attempt to reverse engineer, decompile, or hack any part of the Service.
We reserve the right to suspend or terminate your access for violations.
7. Beta and Experimental Features
Certain features may be marked as “Beta,” “Preview,” or “Experimental.” These are provided as-is, with no guarantee of stability, availability, or data retention.
8. Intellectual Property
Call Snag and its content (software, logos, trademarks, etc.) are the property of Call Snag or its licensors. You may not use, reproduce, or modify any part of the Service without prior written permission.
9. Apple Disclaimer
Call Snag is independent from and not affiliated with Apple Inc. Apple is not responsible for the functionality, performance, or support of the Service.
10. Disclaimers
The Service is provided “as is” and “as available.” We do not guarantee that it will be uninterrupted or error-free.
We disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement.
11. Limitation of Liability
To the fullest extent permitted by law, Call Snag shall not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits or data, arising out of or related to your use of the Service.
12. Indemnification
You agree to indemnify and hold harmless Call Snag and its officers, employees, and affiliates from any claims, liabilities, damages, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.
13. Dispute Resolution and Arbitration
You agree to resolve any disputes related to these Terms or the Service through final and binding arbitration, rather than in court. You may also bring an individual claim in small claims court.
You waive the right to participate in class actions or class-wide arbitration.
14. Export Compliance
You may not use or access the Service in violation of U.S. export laws. You represent that you are not located in a restricted country or on a prohibited party list.
15. Modifications to Terms
We may update these Terms at any time. Material changes will be communicated through the app or by email. Continued use of the Service after changes constitutes acceptance.
16. Termination
We may suspend or terminate your access at any time for any reason, including violation of these Terms. Upon termination, your rights to use the Service will cease immediately.
17. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware, unless arbitration is elected.
